Electronic communication and commerce facilitate the collection of information about individual use of the Internet. Focusing on the case of Comet Systems Inc. and its data gathering practices, this paper explores the technical details of gathering personal information in databases in general and the special character of the privacy issue raised by 'anonymous' information about individual behavior on the Internet. The case analysis suggests new insights for our understanding of privacy and frames a discussion of policy alternatives with respect to (...) the privacy of Internet communication. (shrink)

Drawing on conceptual tools from philosophical bioethics, economics, and materialist feminism, we advocate viewing transnational commercial surrogacy as labor and consider what it means to compensate women for this work. We find two distinct but interrelated concerns emerge in our discussion of wages for surrogates: how to value and compensate for social reproduction, and how to establish a fair wage for surrogates. We explore limitations of minimum wage policy in addressing the undervaluation of biological and emotional labor in the transnational (...) commercial surrogacy industry. We argue that subsidization is a superior method of addressing at least one cause of undervaluation. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. ObjectivesThe present study explores the effect of visual art training on people with dementia, utilizing a randomized control trial design, in order to investigate the effects of an 8-week visual art training program on cognition. In particular, the study examines overall cognition, delayed recall, and working memory, which show deficits in people with dementia.MethodFifty-three individuals with dementia were randomly assigned into either an art training or usual-activity waitlist control group. Overall cognition and delayed recall were assessed with the Montreal Cognitive (...) Assessment, and working memory was assessed with the Backward Digit Span task.ResultsThere were no group differences in overall cognition, or working memory, while a difference in delayed recall was undetermined, based on post-test—pre-test difference scores. Attention Restoration Theory proposes that exposure to natural environments helps to restore attention. For sustained attention—the ongoing application of focus to a task, the effect appears to be modest, and the underlying mechanisms of attention restoration remain unclear. Exposure to nature may improve attention performance through many means: modulation of alertness and one’s connection to nature were investigated here, in two separate studies. In both studies, participants performed the Sustained Attention to Response Task before and immediately after viewing a meadow, (...) ocean, or urban image for 40 s, and then completed the Perceived Restorativeness Scale. In Study 1, an eye-tracker recorded the participants’ tonic pupil diameter during the SARTs, providing a measure of alertness. In Study 2, the effects of connectedness to nature on SART performance and perceived restoration were studied. In both studies, the image viewed was not associated with participants’ sustained attention performance; both nature images were perceived as equally restorative, and more restorative than the urban image. The image viewed was not associated with changes in alertness. Connectedness to nature was not associated with sustained attention performance, but it did moderate the relation between viewing the natural images and perceived restorativeness; participants reporting a higher connection to nature also reported feeling more restored after viewing the nature, but not the urban, images. Dissociation was found between the physiological and behavioral measures and the perceived restorativeness of the images. The results suggest that restoration associated with nature exposure is not associated with modulation of alertness but is associated with connectedness with nature. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

Photonic Crystals is the first book to address one of the newest and most exciting developments in physics--the discovery of photonic band-gap materials and their use in controlling the propagation of light. Recent discoveries show that many of the properties of an electron in a semiconductor crystal can apply to a particle of light in a photonic crystal. This has vast implications for physicists, materials scientists, and electrical engineers and suggests such possible developments as an entirely optical computer. Combining cutting-edge (...) research with the basic theoretical concepts behind photonic crystals, the authors present to undergraduates and researchers a concise, readable, and comprehensive text on these novel materials and their applications. The first chapters develop the theoretical tools of photonic crystals in a broad, intuitive fashion, starting from nothing more than Maxwell's equations and Fourier analysis, and include analogies to traditional solid-state physics and quantum theory. There follows an investigation of the unique phenomena that take place within photonic crystals, at defect sites, and at surfaces and interfaces. The authors offer a new treatment of the traditional multilayer film (a one-dimensional photonic crystal), which allows for the extension to higher dimensions and more complex geometries. After exploring the capabilities of photonic crystals to guide and localize light, the authors demonstrate how these notions can be put to work. (shrink)

This paper reviews current psychological theories of syllogistic inference and establishes that despite their various merits they all contain deficiencies as theories of performance. It presents the results of two experiments, one using syllogisms and the other using three-term series problems, designed to elucidate how the arrangement of terms within the premises affects performance. These data are used in the construction of a theory based on the hypothesis that reasoners construct mental models of the premises, formulate informative conclusions about the (...) relations in the model, and search for alternative models that are counterexamples to these conclusions. This theory, which has been implemented in several computer programs, predicts that two principal factors should affect performance: the figure of the premises, and the number of models that they call for. These predictions were confirmed by a third experiment. Dans cet article sont passées en revue les théories psychologiques du traitement des syllogismes. On établit qu'en dépit de leurs mérites variés toutes sont en défaut en tant que théories de la performance. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Humans have long been characterized as poor probabilistic reasoners when presented with explicit numerical information. Bayesian word problems provide a well-known example of this, where even highly educated and cognitively skilled individuals fail to adhere to mathematical norms. It is widely agreed that natural frequencies can facilitate Bayesian reasoning relative to normalized formats (e.g. probabilities, percentages), both by clarifying logical set-subset relations and by simplifying numerical calculations. Nevertheless, between-study performance on “transparent” Bayesian problems varies widely, and generally remains rather unimpressive. (...) We suggest there has been an over-focus on this representational facilitator (i.e. transparent problem structures) at the expense of the specific logical and numerical processing requirements and the corresponding individual abilities and skills necessary for providing Bayesian-like output given specific verbal and numerical input. We further suggest that understanding this task-individual pair could benefit from considerations from the literature on mathematical cognition, which emphasizes text comprehension and problem solving, along with contributions of online executive working memory, metacognitive regulation, and relevant stored knowledge and skills. We conclude by offering avenues for future research aimed at identifying the stages in problem solving at which correct versus incorrect reasoners depart, and how individual difference might influence this time point. The psychedelic psilocybin has shown promise both as treatment for psychiatric conditions and as a means of improving well-being in healthy individuals. In some jurisdictions (e.g., Oregon, USA), psilocybin use for both purposes is or will soon be allowed and yet, public attitudes toward this shift are understudied. We asked a nationally representative sample of 795 US Americans to evaluate the moral status of psilocybin use in an appropriately licensed setting for either treatment of a psychiatric condition or well-being enhancement. (...) Showing strong bipartisan support, participants rated the individual’s decision as morally positive in both contexts. These results can inform effective policy-making decisions around supervised psilocybin use, given robust public attitudes as elicited in the context of an innovative regulatory model. In lieu of an abstract, here is a brief excerpt of the content:109 HUME'S MISSING SHADE OF BLUE, INTERPRETED AS INVOLVING HABITUAL SPECTRA David Hume claimed that his hypothetical case of the unseen shade of blue posed no fundamental problem to his general empiricist principle. But I believe it well may show exactly what he denied it showed — viz., that his empiricism rests on a mistake. Hume says: Suppose... a person to have enjoyed his sight for thirty years, and (...) to have become perfectly well acquainted with colours of all kinds, excepting one particular shade of blue, for instance, which it never has been his fortune to meet with. Let all the different shades of that colour, except that single one, be plac'd before him, descending gradually from the deepest to the lightest; 'tis plain, that he will perceive a blank, where that shade is wanting, and will be sensible, that there is a greater distance in that place betwixt the contiguous colours, than in any other. Now I ask, whether 'tis possible for him, from his own imagination, to supply this deficiency, and raise up to himself the idea of that particular shade, tho' it had never been conveyed to him by his senses? I believe there are few but will be of opinion that he can.... Sometimes one is surprised by the colour which emerges when one mixes paints, powders or lights of different hues, in the sense that one is unable to imagine this resulting colour until one actually sees it. I often have analogous experiences when sightreading music on the trombone. If there is a large, unfamiliar interval between the note I am playing and the one to be played next, so I cannot 'hear' the next note inwardly, I bring the slide to the correct position, set my lips at approximately the right tension, and presto! the correct note appears, despite 110 my inability to predict what it was going to sound like. Only after I have heard it can I also 'hear' it, i.e, predict its occurrence in this melodic line. Cases like these are not puzzling philosophically, because in them, the note, colour, etc. arises primarily from the equipment used — e.g., paints, powders or lights, the trombone and tension of the lips, and so on — rather than from the mind of the person who uses these things. But in Hume's example, no extra-mental objects or events play a direct role in creating the imagined colour. In fact, this colour never appears at all outside the subject's mind, and he never sees it. Therefore here the imagined colour is produced entirely by the subject himself, without his having copied it from anything in the external world. Yet this contradicts the maxim Hume laid down at the beginning of the Treatise that all simple ideas arise from correspondingly simple (sense) impressions. Two points perhaps mitigate the seriousness of the problem set by the missing shade of blue. First, Hume saw clearly, as Locke did not, that "innate" does 2 not mean the same as "justified." He was not so much concerned with the question of where ideas come from, as with how these ideas can be shown to be legitimate. His answer to the latter question is that experience alone is competent to show this. Second, strictly speaking, no idea is itself a piece of knowledge, but only something with the help of which one constructs knowledge-claims; and it is necessary for a person to justify knowledge-claims which are composed of innate ideas, by checking them against experience, just as much as knowledge-claims composed of non-innate materials. For example, suppose I possess innately the idea (visual image) of blue and the idea (tactile image) of cool. To say that these ideas are innate means that they are merely triggered or activated in my Ill mind by experiences I happen to have, but are not created by these experiences, and are not necessarily copies of them. Nevertheless, in order for me to know something which involves these ideas, I first must put them together in a judgment, and then confirm that judgment by appeal to experience. State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...) wrongdoing by physicians. One of Hume's most well-known works and a masterpiece of philosophy, A Treatise of Human Nature is indubitably worth taking the time to read.

In lieu of an abstract, here is a brief excerpt of the content:192 HUME'S REFUTATION OF — WOLLASTON? Recently while rereading Book III of Hume's Treatise I was struck by an anomaly in the text that I had never noticed before. It consists in the juxtaposition of two arguments Hume offers regarding the source of the moral qualities of our actions. At first I dismissed Hume's arrangement of these arguments as being of little consequence — one of them appears in (...) a footnote — but the more I thought about the juxtaposition the more it intrigued and puzzled me. Expecting that it must have been noted by other readers I checked through the literature to find some discussion of it. Since after a long search I have failed to uncover anything, and believing the point, which relates to Hume's central view concerning morality, to be of some interest, I have decided to write this brief paper. Two passages from § 1, entitled "Moral Distinctions not deriv'd from Reason," of Part I, Book III, are involved. Hume begins the section by arguing that, because of the limited scope of its capacities, reason cannot distinguish between right and wrong or, as he puts it, between virtue and vice, and therefore that it is a mistake to speak of actions as being reasonable or unreasonable. Since Hume's views on this question are well-known and since they are not directly relevant to the point of my paper, I shall not pursue them further, but turn directly to the issue at hand. After having stated his argument at the beginning of § 1 and reached the conclusion that "actions may be laudable or blameable, but they cannot be reasonable or unreasonable," Hume turns to answer an objection that might be made against him by a rationalist ethicist. He writes: 193 But perhaps it may be said, that tho' no will or action can be immediately contradictory to reason, yet we may find such a contradiction in some of the attendants of the action, that is, in its causes or effects (T 459). Pursuing this objection, Hume first considers the causes of our actions. He acknowledges that we can be led astray in what we do in two ways; by making mistakes of fact, first, about the nature of some object we desire (e.g., thinking some fruit delicious when it really is not) and, second, about the means we should employ to gain the object (e.g., attempting to pluck the fruit when it is beyond our reach). Although these errors cause us to act in ways that may be termed unreasonable in a "figurative and improper way of speaking" (T 459), they cannot be the source of any immorality in what we do because they are committed involuntarily and innocently. A person who falls into such errors and acts on them is "more to be lamented than blam'd" (T 459). To conclude his answer to the rationalistic objection he has raised, Hume turns next to the issue of whether the immorality of our actions can be explained in terms of the unreasonableness of any of their effects. In a memorable passage he denies that the fact that false judgments are the effects of our actions can be the source of immorality in what we do. As to those judgments which are the effects of our actions, and which, when false, give occasion to pronounce the actions contrary to truth and reason; we may observe, that our actions never cause any judgment, either true or false, in ourselves, and that 'tis only on others they have such an influence. 'Tis certain, that an action, on many occasions, may give rise to false conclusions in others; and that a 194 person, who thro' a window sees any lewd behaviour of mine with my neighbour's wife, may be so simple as to imagine she is certainly my own. In this respect my action resembles somewhat a lye or falshood; only with this difference, which is material, that I perform not the action with any intention of giving rise to a false judgment in another, but merely to satisfy my lust and passion. In mill the principle of utility does not ascribe rightness or wrongness to anything. It governs not just morality but the whole art of life. It says that happiness is the only thing desirable as an end. But the meaning of this formulation is problematic, Since mill's theory of practical reason conceives this desirability as an end as generating reasons for action for all agents in a way implying impartiality between self and others, Whereas in the ordinary sense it does (...) not. J. Angelo Corlett’s response to Leigh Turner defends the current practice of anonymous refereeing in scholarly journals. In reply to him: a slightly refined proposal for signed referees’ reports, with temporarily blind refereeing, would restore to the process of publication, in philosophy at least, the sense of responsibility for rational debate, cooperation, mutual criticism, and simple courtesy which is expected among colleagues in public academic relations, and would also allow more credit for the difficult task for refereeing. Personal observation of (...) the quality of referees’ reports suggests that a gathering of anecdotal evidence would show the need for reform. (shrink)

Revisionist interpretation of Mill needs to be extended to deal with a residue of puzzles about his moral theory and its connection with his theory of liberty. The upshot shows his reinterpretation of his Benthamite tradition as a form of ‘philosophical utilitarianism’; his definition of the art of morality as collective self-defence; his ignoring of maximization in favour of ad hoc dealing in utilities; the central role of his account of the justice of punishment; the marginal role of the internal (...) sanction in his criterion of moral wrong; his deep respect for common-sense morality; and his restriction of the scope of morality so as to claim for the utilitarian tradition the whole realm of the aesthetics of conduct as part of a general theory of practical reason. IN a letter to the Editor of MIND, Mr. G. T. Bennett of Emmanuel College, Cambridge, points out a stupid slip which I made on page 499 of MIND, N.S., No. 124. In illustrating Mr. Johnson's analysis of the subsumptive syllogism in my review of his Logic, Part II., I took as a major premise the proposition “Everything with sides and angles is equiangular, if equilateral”. This is, of course, ridiculously false, as Mr. Bennett points out. A figure made (...) of four equal jointed rods could be pushed into many different shapes. I want to make it quite clear that this is a slip.of my own, and that nothing of the kind occurs in Mr. Johnson's book. Of course, for purposes of illustration, it is a matter of indifference whether we choose false propositions or true ones, so that no injustice has been done to Mr. Johnson's theory. But I am not going to pretend that I did not think this proposition to be true at the moment when I wrote it down. I am sorry to have been so careless, and I should be still more sorry if anyone should have ascribed the carelessness to Mr. Johnson himself and not to his reviewer. I must thank Mr. Bennett for pointing out the mistake. (shrink)
